1. Introduction
1.1 These Terms & Conditions (“Terms”) govern your use of the GoThrills website and platform (the “Site”) and the booking of activities offered by third-party providers (“Providers”). By browsing the Site, creating an account, or making a booking, you agree to these Terms.
1.2 These Terms cover platform use and booking via GoThrills. They do not govern the performance of the activity itself, which is provided under the Provider’s own terms.
1.3 GoThrills may update these Terms from time to time. Changes take effect when posted on the Site. Please review them periodically.
2. Definitions
2.1 “Activity” means a sporting, leisure or adventure activity or related service offered by a Provider on the Site and, where applicable, booked by a Customer through the Service.
2.2 “Customer” means a user who makes a booking via the Site.
2.3 “Participant” means the person(s) who will take part in the Activity (which may or may not be the Customer).
2.4 “Provider” means the business that lists and delivers the Activity.
2.5 “Platform / Service” means the technical service operated by GoThrills that enables Users to discover, book, pay for, cancel and (where applicable) obtain refunds for Activities.
2.6 “Site” means www.gothrills.co.uk and any related subdomains.
2.7 “User” means any person who browses or uses the Site.
2.8 “Booking Price” means the price paid for the Activity only (excluding any travel, accommodation or other ancillary costs).
3. Our Service & Role as Agent
3.1 GoThrills operates a platform that technically links Users/Customers with Providers of adrenaline and adventure Activities. The Service includes handling bookings, payments, and assisting with cancellations/refunds in accordance with these Terms.
3.2 Agency only. GoThrills acts solely as agent for Providers. We do not own, operate or deliver Activities. Your contract for the Activity is directly with the Provider.
3.3 By booking an Activity with a Provider, you enter into a direct agreement with that Provider. The Provider’s own terms apply together with these Terms. The Provider’s cancellation policy can be shown before booking, found at the bottom of the Activity Product Page.
3.4 GoThrills is not responsible for the delivery, safety, legality or quality of Activities provided by Providers.
4. Access to the Service & Accounts
4.1 You are responsible for the equipment, connectivity and costs required to access the Site.
4.2 To reserve an Activity you may need to create an account and provide accurate, current information, updating it when necessary.
4.3 Keep your login credentials confidential. You are responsible for all activity under your account. If you suspect unauthorised use, change your password immediately and notify us.
4.4 Any access using your valid credentials may be treated as authorised by you.
5. Booking Process
5.1 Booking request. A Customer submits a booking request with the Provider through the Site and may need to provide information about each Participant’s suitability (e.g., health, experience, licences).
5.2 Pre-authorisation & capture. We may place a payment pre-authorisation on your card. On Provider acceptance, the Booking Price will be charged.
5.3 Provider acceptance. Providers are notified automatically and normally have up to 24 hours to accept or decline. If not accepted within that time, you may cancel the request with no charge.
5.4 Contract formation. Once the Provider accepts, a contract is formed between you and the Provider, and your payment is captured.
5.5 Booking summary & venue details. After confirmation, we email a booking summary (date/time, location/meeting point/postcode, Provider name, Activity name, participants, and contact details). Please use the provided postcode and directions; we are not liable if you cannot locate the venue due to failure to follow the information supplied.
6. Payment
6.1 You must be at least 18 to book and legally capable of entering into contracts.
6.2 Full payment of the Booking Price is required at confirmation; we process payments on the Provider’s behalf.
6.3 You are responsible for ensuring booking information is accurate.
7. Cancellations, Refunds & Rescheduling
7.1 Pre-contract information. The Provider’s cancellation policy can be shown before booking, found at the bottom of the Activity Product Page. Nothing in this section limits your statutory rights.
7.2 Customer cancellations. If you cancel, the Provider’s cancellation policy which can be shown before booking, found at the bottom of the Activity Product Page applies (including any fees or non-refundability). Where a Provider’s policy is more generous than these Terms, the Provider’s policy prevails.
7.3 Rescheduling at your request. If you wish to change date/time, contact us as early as possible and no later than 72 hours before the start time. Where the Provider agrees and availability exists, we will reschedule the existing booking to the agreed slot without requiring cancellation and re-booking. If the Provider cannot accommodate, the original booking and Provider policy remain in force.
7.4 Late arrival / no-show / customer fault. If you arrive late, fail to attend, do not meet stated age/weight/health/licensing requirements, refuse mandatory briefings/waivers, or attend under the influence of alcohol/drugs, the Provider may refuse participation and no refund will be due (see 8.6 Arrival Times).
7.5 Provider cancellations & rescheduling window. If a Provider cannot deliver on the confirmed date/time (including weather, safety, venue or operational reasons), the Provider must offer you: (a) one or more suitable alternatives within 2 days before to 3 days after your original date; or (b) the next available date/time at that venue. You must respond within a reasonable time after we contact you. If no suitable alternative is available or agreed, clause 7.6 applies.
7.6 GoThrills Refund Guarantee — when we refund you. GoThrills guarantees a full refund of the Booking Price (to the original payment method) where:
(a) the Provider cannot deliver and a suitable reschedule under 7.5 cannot be agreed;
(b) there is a material misdescription or material change from what was advertised and you decline the offered alternative;
(c) the Activity is not provided despite your attendance for reasons not caused by you; or
(d) a refund is required by law.
Refunds under this clause are issued by GoThrills within 10 business days of confirming eligibility.
7.7 How reschedules are processed. Reschedules under 7.3 and 7.5 are coordinated by GoThrills. Once you and the Provider confirm in writing (email or in-platform message), we may update the booking and send a new confirmation. We may request reasonable proof of consent from both sides.
7.8 Dissatisfaction with the experience. Raise issues on the day with the Provider so they can try to resolve. Then contact GoThrills within 48 hours with details (what happened, when/where, who you spoke to, photos). We will review with the Provider and aim to propose a resolution within 5 business days. Outcomes may include re-performance/re-booking, a partial refund or goodwill credit where service fell below the stated description/standard, or a full refund where there is a material failure (see 7.6(b)–(c)). Where the Activity matched its description and was delivered safely and in full, subjective dissatisfaction alone will not usually qualify for a refund, though we may offer a goodwill credit at our discretion.
7.9 Scope of refunds. Refunds cover the Booking Price only. GoThrills and the Provider are not liable for ancillary or consequential costs (travel, accommodation, time off work, etc.).
7.10 Chargebacks. Filing a card chargeback will cancel the booking. We may provide the card issuer with records of communications, Provider policies and attendance evidence.
7.11 Complaints linked to cancellations/reschedules. Raise issues with the Provider on the day where possible. For platform-related issues, contact GoThrills promptly so we can review under 7.6.
8. Customer Responsibilities (Participation & Safety)
8.1 You must ensure all Participants meet eligibility, health and fitness requirements stated by the Provider.
8.2 Follow all Provider instructions, safety rules and regulations at all times.
8.3 Disclose any relevant medical or physical conditions that could affect participation and seek medical advice if unsure.
8.4 Providers may require signed risk acknowledgements/waivers and appropriate licences (e.g., driving licence). Refusal to sign mandatory waivers may be treated as a cancellation/no-show with no refund.
8.5 You are responsible for your own insurance (travel, health and personal accident).
8.6 Arrival Times. You must be ready to participate at least 30 minutes before the designated start time (unless your confirmation states otherwise) to complete registration and safety briefings. The time shown on your confirmation is the activity start time, not the arrival time. Some venues may require earlier arrival—please check your confirmation. Late arrival may be treated as a cancellation/no-show with loss of the Booking Price, and the Provider may refuse participation—particularly where they have a tight operating schedule. Please plan your journey to allow for delays.
9. Risk Acknowledgement & Waiver
9.1 Participation in adventure activities involves inherent risks, including injury, illness, property damage or death. By booking, you acknowledge and accept these risks.
9.2 GoThrills is not responsible for any injury, loss or damage suffered during or as a result of an Activity. The Provider is solely responsible for delivery of the Activity.
9.3 We strongly recommend appropriate personal accident or travel insurance.
10. Website Use & Restrictions
10.1 You must not: (a) publish Site material elsewhere without permission; (b) sell, sublicense or commercially exploit Site material; (c) publicly perform or show Site material; (d) use the Site in a way that could damage, disable, overburden or impair it or interfere with others’ use; (e) use the Site contrary to law; (f) scrape, crawl, mine, harvest or extract data from the Site without our written consent; (g) use the Site to send unauthorised advertising or marketing.
10.2 We may restrict access to parts of the Site at any time. Any user ID and password are confidential; you must maintain their confidentiality (see 4.3).
11. Intellectual Property
11.1 All non-Provider content on the Site is owned by GoThrills or its licensors.
11.2 You may not copy, reproduce, distribute, adapt, translate or create derivative works from our content without prior written permission.
12. Liability
12.1 To the fullest extent permitted by law, GoThrills excludes all liability for: (a) any injury, accident, loss, damage or expense incurred during an Activity; (b) any act, omission, negligence or failure by a Provider; and (c) any cancellation, overbooking, or dissatisfaction with the experience, subject to 7.6.
12.2 We do not guarantee the accuracy of Provider information and are not liable for misrepresentations made by Providers.
12.3 Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be limited.
13. Complaints & Disputes
13.1 Any concerns during an Activity should be raised immediately with the Provider.
13.2 We may assist in communications but are not responsible for resolving disputes. For issues relating to cancellations, rescheduling or dissatisfaction, see Section 7.
14. Variation of Terms
14.1 We may revise these Terms at any time by posting the updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance.
15. Indemnity
15.1 You agree to indemnify and hold harmless GoThrills from reasonable losses, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, unlawful use of the Site, or infringement of third-party rights, except to the extent caused by GoThrills’ own breach or negligence.
16. Severability
16.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
17. Entire Agreement
17.1 These Terms constitute the entire agreement between you and GoThrills regarding Site use and bookings via the Platform and supersede all prior understandings relating to the same subject matter.
18. Governing Law & Jurisdiction
18.1 These Terms and any non-contractual obligations arising out of them are governed by the laws of England and Wales.
18.2 The courts of England and Wales shall have exclusive jurisdiction, without affecting any consumer right to bring proceedings in their local court where mandatory law so provides.
